New Jersey Cannabis Legislation

New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization (CREAMM) Act – 2021:

Enacted on February 22, 2021, this legislation established the framework for the legal sale and use of recreational cannabis in the state. It allows adults 21 and older to possess up to 6 ounces of cannabis and outlines the regulatory structure for the industry.

Marijuana Decriminalization Law – 2021:

Also signed on February 22, 2021, this law decriminalizes the possession of small amounts of marijuana and hashish, reducing penalties and addressing past convictions.

New Jersey Cannabis Regulatory Commission (NJ-CRC)

State agency responsible for overseeing both medicinal and recreational cannabis industries in New Jersey. Established under the Jake Honig Compassionate Use Medical Cannabis Act in 2019, the commission's mandate expanded with the enactment of the Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization (CREAMM) Act in 2021.

Mission and Responsibilities:

The NJ-CRC aims to develop and regulate a responsible, safe, and equitable cannabis industry. Its core responsibilities include:

  • Licensing: Issuing licenses for medicinal and recreational cannabis businesses, encompassing cultivation, manufacturing, distribution, retail, and testing facilities.

  • Regulation: Establishing and enforcing rules to ensure product safety, quality control, and compliance with state laws.

  • Equity Initiatives: Promoting diversity and inclusion within the industry by prioritizing applications from social equity businesses, diversely owned businesses, and those in impact zones.

  • Public Health and Safety: Implementing measures to protect public health, including setting standards for packaging, labeling, and advertising to prevent youth access and consumption.

  • All cannabis establishments, cannabis distributors or cannabis delivery services are hereby prohibited from operating anywhere within the geographic boundaries of the Township of Medford

Development Regulation - DR-307 - Right To Farm, Permitted Use in All Zones

  • The right to farm land is hereby recognized to exist in the Township of Medford, in the County of Burlington, and is hereby declared a permitted use in all zones of this Township

  • Production of agricultural and horticultural crops, trees and forest products...

  • Erection of necessary agricultural buildings ancillary to agricultural and horticultural production.

  • Use of irrigation pumps and equipment, aerial and ground seeding and spraying, tractors, harvest aides and other equipment.

  • It is hereby determined that whatever nuisance may be caused to others by these uses and activities is more than offset by the benefits of farming to the neighborhood community and society in general.
